I an satisfied the Crown had discharged the onus of proof in respect of the 1st charge and I accordingly find the 1st and 2nd accused guilty of the 1st charge.
I have read the relevant pages of the transcript of the triel of N. v. Cunningham and Thompson, Criminal Case No. 144 of 2015 heard before ng brother Garcia, which transcript was cortified as accurate by my brother Gerçia's judicial clerk, and I am satisfied that the 1st accused denied on oath the facts referred to in the 2nd charge knowing the same to be untrue and that that statement by tho 1st accused was material in that trial.

In respect of the perjury charges I am aware of the statutory requirement for corroboration. I believe the evidence of LEUNG Wing-sang and CHAN Loi-fat that the 1st accused and the 2nd accused did meet DUNG Ving-sang at the Harbour Hotel on the night of the 30th July, 1973 prior to his arrest and that amongst those prosent was a person known as Tai and that, at that meeting, $10,000 was paid to HEUNG Ving-sang and that the 2nd accused was prosent vhen suol. payment was made. I have already rejected submissions that UNG Wing-sang and/or CH Loi-fat were accomplices to the penjmy chargus.
I find the 1st accused guilty of the 2nd, 3rd and 4th changes and the and accused guilty of the 5th and 6th charges.

If your Honour pleases, the 1st accused hac one previous conviction, not of a similar nature, in respect of Section 10 of tho Bribery Ordinance in March, 1974 and he was sentenced to 12 months' imprisonment. The 2nd accused, your Honour, has no previous convictions.

The 2nd accused, your Honour, ic aged 39 and has been with the Royal Nong Hong Police Force since the 5th of February, 1757, which takes his number of years of service with the Force 19 years and û months. He was with the C.I.D., your Honour, for about 13 years and he was promoted from constable to a sergeant on the 26th of February, 1973, and at the time of his arrest in June this year he was a sergeant. He is married, your Honour, and has thres children whose ages range from 2 to 5 years. His wife is presantly pregnant and will be giving birth in about 2 weeks' time.
