On the 1st August, 1973 DLUNG Wing-sang was charged not viti, murder, but with six counts of vounding. He merely wrote unbrstand. On the 5th November, 1973 LOLIG was committed for trial for under and wounding. On the 9 January, 1974 LIC vas con- victs 1 of murder. On the 9th March, 1974 LEUNG's appeal was dismissed. Sone tine in March, 1974 LAUNG's mother made a complaint to OPELCO. In Hay, 1974 Superintendent McNiven took verions state- Lonts including soue fron witnesses for the prosecution and for the deicnce. On the 1st March, 1976 a Commission of inquiry began to hoer evidence and on the 31st liarch, 1976 Hr. Justice VAIG presented his report.

Both LEUNG and CIA testified that the mood in which they net the two accused in the Harbour Hotel faced the harbour and was carpeted and contained, inter alia, a "single bed which one estinated to be 4 feet and the other feet 6 inches. P.V. 6 who testified to a heating in a roc: at the Harbour Hotel, though, he said it was held in the afternoon and not on the 30th July 1973, said the floor was "wooden and he couldn't reneLiber whether it vas carpatod. le.said there was an air-conditioner attached to the window. Hr. Toury LAU Chiu-shall, the assistant general manager of the Harbour Hotel produced the hotel register for the 30th July, 1973 which did not show the 1st accused's name. He said the 1st acclised Frequently frequented the coffee shop. He said, in effect, that it would have been impossible for the 1st and/or 2nd accused to book a soon through the management but if it had been done by contract with the roon boys, then that would to beyond the management's control. He said members of the management frequently made random checks of cmpty roous because they were afraid that some of their "ickis Yould let out rooms to guests privately without informing the nanagement. He said that all roens facing the harbour had tvin beds except for one room which had a double bod. Mr. LAU testified that the register showed that the 2nd accused had registered as a guest from the 18th to 21st July, 1973.

The 2nd accused gave evidence end called six other vitnesses. on his behalf. The 1st accused failed to answer to his bail and 2 ruled that the trial continue against the 1st accused notwithstanding

is absence.

It is clear from the cross-examination of LEUNG by Hr. Vore that the 1st accused denied ever meeting UIG on any of the other naned co-conspirators in the Harbour Hotel or acting in any vay contrary to his public duty as a police officer in relation to the police investigation of the Cactus incident.

The 2nd accused's defence, in short, is that he never, either with th: 1st accused or by himself, net LIUIG or any of the other named co-conspirators in the Harbour Hotel nor did he act in any way contrary to his public duty as a police officer in relation to the police investigation of the Cactus incident.

The 2nd accused testified that on the 30th July, 1973 aftor 5.00 p... he saw the 1st accused who asked him to wait for him at about 7.00 p.a. to go with his and his informer to look for someone in connection with the Cactus case. A little aiter 7.00 p.m. he wont with the 1st accused to the Tai Loi Restaurant in Lockhart Road
