I will confine myself to referring to this witness (a naned co- conspirator) as P.. 6 as he has been committed to stand trial in She Supreme Court, with five others, in respect of the Cactus incident. These twenty-two persons were released on police bail to agroam at the Wanchai Police Station on the 1st July, 1973.

The evidence leading to the arrest of LEUNG Wing-sang and his movements (and that of the police) after his arrest, are some- vhat craordinary. A nention, in broad outline, of the prosecution and defence evidence might be helpful. Although it might be argued that in the circumstances of this case, a more detailed account of tho avilence would be helpful in that such an approach might bond to locus the points of convergence as well as divergence in the evidence, I have rejected that approach. Much of the evidence relatos to visits by curtain people to certain place, who was present and what was said at those Leetings. To have recited all this evidence would have buon unhelpful, if not confusing.

in giving a broad outline of the evidence for the prosecution I will painly touch on the evidence of two prosecution witnesses, 12013 ding-sang and CHANT Loi-fat.' LEUNG was in the witness stand for sixteen hours and CHAN over six hours. This is not to say I have not considered all the other evidence. I will, d a later stage, comment specifically on my evaluation of the evidence of P.li. 5. Hiero vas aiduced by the prosecution evidence that towards the ond 120 July, 1973 there wore a number of meetings between the named

co-conspirators or some of then, and also with one LI Tze-loung. Thes: included two nectings at the James Bond Restaurant in Nathan ibat, one near the vicinity of the Lion Rock Tunnel, one at the Foi Chan Cafe in Prince Edward load, then the same day at the Shatin Hotel, then the sam ovozing at the Tng ipar Shan Fong Restaurant near the Shiness University at about 10.00 p.m. and finally, also on the same sign, a meting in a room at the Harbour Hotel in Wanchai together with the 1st and 2nd accused. The meetings prior to the one alleged in the Harbour Hotel were, in general terms, to find IRUNG and to porsade bin to give himself up expressly, or at least by implication, in order to "save" the twenty-two persons who, I have already mentioned, vers arrested between the 19th and 23rd July, 1973. Neither the 1st nor 2nd accused was present at any of the alleged meetings prior to the alleged meeting in the Harbour Hotel but the name of the 1st accused was allegedly mentioned at some of those meetings.

The group of persons present at the Shatin Hotel on the 300: July, 1973 comprised P.. 6, YIK Chung, Tai B, CHAN Loi-fat and Lane Ving-sang (all named co-conspirators) together with one LI Izo-louns. This group then proceeded to the Yung Kgar Shai Fong

starmant near the Chinese University and subsequently to a roo i. the Harbour Hotel. LI Tze-leung did not go up.

CEN testified that when they got to the room in the Harbour Hotel "tvo portly gentlemen" when he came to know as the Let and 2nd accused vero in the rood. LUNG testified that the door vaz opened by a nan he came to lov as the 2nd accused and that the 1st accused arrived a short whils after. The conversation in the Zoop vas overbeard by the 2nd accused.
