Your letter of the 24th October addressed to the
A.G. has been handed to me for attention.
This gentleman has lodged similar complaints with
the A.G., Commissioner of Police and UMELCO.
There appears to be no real dispute as to the facts. A passenger boarded the Defendant's taxi and required him to go to a certain place. When they arrived near that place the Defendant refused to proceed further on the grounds that to do so would entail driving down a private road which the Defendant alleges was dangerous.
As regards the above's complaint regarding 5 appearances in Court, I think I can do no better than enclose a copy of a letter from the First Clerk of the Fanling Magistracy which sets out in detail the reason for the adjournments.
I would suggest that there has been no miscarriage of justice in this case in that the facts were virtually agreed and the Defendant took the opportunities available to him to put his defence to the magistrate who, after listening to everything that had been said and viewing the locus in quo, came to the conclusion that he was guilty as charged.
