Explanatory Memorandum
The purpose of this Bill is to amend provisions
of the principal ordinance which deal with noise.

Clause 2 repeals and replaces section 6 of
the principal Ordinance to provide for a more substantial
fine of $2,000 where street cries or noises (for the
purposes of buying or selling) are made through amplified
means. Under subsection (2) of the proposed new section,
where such cries or noises (whether made through amplified
means or not) are emitted from business premises, it will
be presumed, until the contrary is proved, that they
were made for the purpose of buying or selling or
with the object of attracting attention to the goods
displayed therein.

Clause 3 of the Bill extends section 13 of
the principal Ordinance to place a ban on the use of
all powered mechanical equipment for the purposes of
carrying out any work between the hours of 7 p.m. and
7 a.m. and on public holidays. The existing restriction
relates only to piling between the hours of 3 p.m. and
6 a.m. and on public holidays. The clause also provides
for a definition of the term "powered mechanical
equipment in section 13(7). Exceptions to the general
ban are set out in new subsection (1A). It will be
