2 The principal Ordinance is amended by adding section 6A the following new section:

"Amplifying

records in public places or trade

premises.

6B. (1) Any person who in a public place or in any premises used for the purposes of any trade or business

(a)

operates or uses; or

(b) causes or permits any person

to operate or use,

in connection with any trade or business any loudspeaker or megaphone, or any advice or equipment for magnifying sound, to amplify the sounds reproduced from a record so that the sounds thereby magnified can be heard in a public place commits an offence and is liable to a fine of five thousand dollars.

(2). In this section "record" means any disc, tape, perforated roll or other device in which sounds are embodied. so as to be capable (with or without the aid of some other instrument) of being automatically reproduced therefrom".

Honourable Members will be asked to advise:

whether the revised draft clause 2 to the Summary Offences (Amendment) (No 2) Bill 1977 as set out at paragraph 2 above should be incorporated into the bill; and further

whether the Summary Offences (Amendment) (No 2) Bill 1977, at Annex A to XCR(77)146 should be introduced into the Legislative Council; and

under section 37 of the Summary Offences Ordinance, whether the Summary Offences (Night Work) (Amend- ment) Regulations 1977, at Annex B to XCR(77)146 should be approved in principle to be submitted to Honourable Members to be made after the bill has passed into law.
