the Director of Public Works may order work to be stopped if he considers that the noise created by the works is causing unnecessary disturbance and

annoyance to the public.

A clause has been included in the contract, stipulating that the con- tractor shall be bound by any restrictions imposed by the Government in granting exemption from section 13 of the Summary Offences Ordinance for works performed outside normal working hours.

Public relations aspects

Should Honourable Members advise that the proposed order be made, the Director of Public Works and the Director of Information Services will issue a press statement explaining the justification for the exemption. As the conditions set out in paragraph 8 above are stringent, it is unlikely that there will be any adverse public reaction.

Advice sought

Honourable Members are asked to advise, under section 13(4) of the Summary Offences Ordinance (Chapter 228), whether the Summary Offences Ordinance (Exemption from section 13) (No 5) Order B 1977 at Annex B should be made.

(The Director of Engineering Development (Mr H.D. STEAD) and the Principal Assistant Secretary for the Environment (Mr A. P. BENNETT) will attend before the Council for the discussion of this item).
