Crown Lands Resumption Ordinance

(Chapter 124)

RESUMPTION OF LAND FOR STAGE IIA DEVELOPMENT RIVER TRAINING WORKS IN LAM TEI AND FU TEI (PACKAGE 15) TUEN MUN, NEW TERRITORIES

On 5th July 1977, having considered memorandum XCR(77)184, Honourable Members advised and the Governor decided that the re- sumption of 2, 271, 508 square feet (about 211, 030 square metres) of private agricultural land in Areas 3, 5 and 51 of Tuen Mun New Town was necessary in order to proceed with the implementation of site formation and river training works in the said areas which form part of Package 15 Development.. The resumption of this land has accordingly been ordered,

The Director of Public Works has now recommended the resumption of 29, 881, 4 square metres (or about 321, 639 square feet) of private agricultural land to implement the next stage of the river training works in Lam Tei and Fu Tei in Tuen Mun, New Territories. This project, which is included in the Tuen Mun New Town Engineering Development Stage IIA, Package 15, is in Category 'A' of the Public Works Programme. Development work is, scheduled to commence in December 1977.

The general location of the land is shown coloured orange on the Identification plan at Annex A. The Secretary for the New Territories is satisfied that the land to be resumed is the minimum necessary to implement this project. Compensation for resumption and clearance is estimated at $2.3 million and funds are available in the approved project estimate to meet the expenditure. The ex-gratia allowance payable for the single commercial undertaking affected is estimated at $10,000 and will be paid from the Housing Department's compensation vote under which funds are also available.

The clearance will involve payment of compensation for crops, fruit trees, beehives and wells together with ex-gratia allowance to cultivators and ex-gratia disturbance allowance for displaced pig- breeders and poultry farmers.
