Area 12A of Sha Tin New Town will be developed as a recreation ground and for district open space as part of the Sha Tin New Town Stage I, Phase II development works which are in Category A of the Public Works Programme. In order that site formation may start as scheduled in April 1978, it is necessary to acquire private agricultural land to the north of the Shing Mun River in Area 12A of the New Town. Site formation works will take twelve months to complete.

The Director of Public Works has accordingly recommended the resumption of 27, 257 square metres (about 293, 393 square feet) of agricultural land in Sha Tin Area 12A. The general location of the land to be resumed is shown coloured orange on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the area of private agricultural land involved in this resumption is the minimum necessary to implement the project. Compensation for resumption and clearance is estimated at $6 million and sufficient funds are available within the approved project estimated to meet this expenditure, provided that land exchange entitlements are accepted as expected. The cost of ex-gratia allowance for commercial and industrial undertakings is estimated at $1.62 million and will be paid from the compensation vote of the Housing Department under which funds are also available,

The clearance will involve payment of compensation for crops, fruit trees, bamboos, irrigation pipes and fences, ex-gratia allowance for cultivators and ex-gratia disturbance allowance for displaced pigbreeders and poultry farmers, together with Tun Fu ceremonial fees.

No building land is involved in this resumption. However, 156 temporary structures (42 on Crown land and 114 on private land) situated within the resumption/clearance limits and used for domestic purposes will have to be cleared. These temporary structures are
