(26) The tenancy of the area coloured blue on the plan annexed hereto and the construction of the slipway or slipways thereon shall be subject to any vessel having the right to pass or repass over the area coloured blue except when a vessel is in the course of being slipped into or out of the water from or to the adjoining land.

(27) In the event of any dispute arising out of the public right of pass and repass over the area coloured blue on the plan annexed hereto the matter shall be referred to the Director of Marine whose decision shall be final.

(28) The purchaser shall within 24 months from the date of this Agreement complete the slip- way or slipways referred to in Special Conditions 23 and 24 and open and commence to operate a ship/boat building and repairing yard on the lot.

(29) Any rights pertaining to the sea frontage shall extend only to that boundary of the lot marked A-B on the plan annexed hereto and will continue to attach to the lot but only so long as the lot continues to have a marine frontage and is used for ship/boat building and repairing.

(30) In the event of any authorized building works on the lot being exempt from the provi- sions of Sections 4, 7, 9, 9A, 9B, 9C, 12, 14, 15, 19 and 20A of the Buildings Ordinance, 1955 and the provisions of the Regulations made thereunder, the following conditions shall apply:-

(a) No building works, site development works or drainage works shall be commenced on the lot until such plans and other details as may be considered necessary by the District Commissioner, New Territories shall have been prepared and submitted in duplicate to and approved in writing by the said District Commissioner.

(b) No alterations or additions to the buildings at present standing or at any time here- after to be erected on the lot shall be made without the consent in writing of the said District Commissioner.

(c) Within two weeks of the completion of any building hereafter to be erected on the lot the purchaser shall inform the said District Commissioner in writing of such completion.

(d) No building at any time hereafter to be erected on the lot shall be occupied in any way except by not more than two watchmen, until the said District Commissioner shall have given his consent in writing to the occupation of the building.

(e) Unless and only so far as otherwise provided in these Conditions, building plans, structural details and calculations in respect of any building at any time hereafter to be erected on the lot shall be prepared in accordance with the provisions of the Buildings Ordinance, 1955, any Regulations made thereunder and any amending legislation.
