The clearance will also involve cultivated Crown land and payment of compensation for crops, trees, fruit trees, flowers and bamboos, ex-gratia allowance for cultivators and compensation for the reprovisioning of a footpath, water pipes, fences and wells will be necessary. Ex-gratia disturbance allowance will also be paid to the displaced pig and poultry breeders.

Thirty-four (34) temporary structures (thirty-three (33) on private land and one (1) on Crown land) used for domestic purposes will have to be cleared. These domestic structures are occupied by 22 families comprising some ninety-four (94) persons, who, if found eligible, will be offered public housing (probably at Kwai Chung or Tuen Mun) and rehousing allowance, which will be paid by the Director of Housing on the recommendation of the Director of Social Welfare, or they will be offered spaces in a local temporary housing area if no suitable public housing is available. In the latter case, an ex-gratia building allowance of $1,000 per family will be paid. Those families found to be ineligible for public housing will be given spaces in a temporary housing area but will not be eligible for the ex-gratia building allowance.

In addition to the structures mentioned above, the resumption will involve clearance of 69 other temporary structures used as work- shops, chicken sheds, etc. Ex-gratia allowance estimated at $65,000 for two shops and three workshops in temporary structures will be paid from the Housing Department's Compensation Vote under which funds are available.

Negotiations to obtain voluntary surrender of the private land are still in progress but the institution of formal resumption proceedings is recommended to avoid any delays which may be caused by absentee landowners or registration of succession. As the land to be resumed lies within the area covered by the Sheung Shui/Shek Wu Hui/Fanling Outline Zoning Plan and the Fanling Layout Plan, the owners of private agricultural land will be offered the alternative of land exchanges on Letter B terms with a credit of $10 per square foot or cash compensation, which will include an ex-gratia payment to bring the total compensation up to $17 per square foot if the cash offer is accepted prior to the date of reversion. Owners of private building land will be offered a Letter B exchange with a credit of $40 per square foot or cash compensation. It is expected that land exchange entitle- ments will be accepted by owners of about 90% of the land affected and that the amount of cash compensation to be paid out will, therefore, be reduced accordingly.
