Background

The Lands Tribunal Ordinance (Chapter 17) was enacted in 1974 to establish a Lands Tribunal but no provision was included in the Ordinance for the attachment to the Tribunal of a registrar and other staff to carry out the administrative functions of the Tribunal. The Tribunal started to function in November 1976 and the need for such a provision has now become apparent.

The new section 7A in clause 3 of the bill enables the Governor to attach to the Lands Tribunal a registrar and other staff who will generally have the same powers as equivalent officers of the Supreme Court. The new section is similar to section 6 (officers of the tribunal) of the Labour Tribunal Ordinance (Chapter 25). The new sections 7B and 7C in clause 3 give the registrar, and a deputy registrar or assistant registrar, of the Tribunal the benefit of the same protection as attaches by virtue of sections 39 and 40 of the Supreme Court Ordinance (Chapter 4) to the Registrar, and a deputy or assistant registrar, of the Supreme Court.
Financial Matters

No additional expenditure will be involved as a result of the bill. The Tribunal has a registrar and other staff and the purpose of the bill is to enable statutory recognition to be given for their functioning as officers of the Tribunal.
