The Director of Immigration has reconsidered the application, looking particularly for any special grounds for treating Mr Yam and Miss Ly as man and wife. However, any period of cohabitation was extremely short, and there is nothing in the letters written by either Miss Ly or Mr Yam which would suggest that there has been a genuine marriage. The Director concludes that there are insufficient grounds for making an exception and recommends that the refusal be maintained.

Honourable Members will be asked to advise, under section 53 of the Immigration Ordinance (Chapter 115), whether the decision of the Director of Immigration not to allow Madam LY Muoi to enter Hong Kong should be maintained or reversed.
(The Deputy Director of Immigration (Mr A.J. CARTER) will be standing by in case Honourable Members should wish to ask him any questions).

is a bona-fide permanent resident of the Colony of Hong Kong,
holding Hong Kong Identity Card No.A811084 issued on 10th day
of July 1965 by the Commissioner of Registration of Persons
Department and Certificate or Identity No.C301035 issued to
him by the Director of Immigration Department on the 7th day
of June 1973.

That your Humble Petitioner is wholly of Chinese
race and was born on the 15th day of October, 1941 at Hek Shan
District of Kwangtung Province, China.

That your Humble Petitioner is being employed by

of No.426
Shanghai Street, 8th floor, Kowloon in the said Colony of Hong
Kong on a monthly salary of $1,170.00 and has been in the said
service fer about four years.

That your Humble Petitioner has visited Saigon,
Vietnam on the 20th day of January 1974 and stayed there until
28th day of January 1974 for the purpose of getting married
with former Miss LY Muoi
who was born at Saigon,
Vietnam on 29th day of August 1944 and of Chinese parentage.

issued on 29th day of August 1969 at Saigon.

That your Humble Petitioner said visit to Saigon
aforesaid is evidenced by the endorsments of his departure and
landing appeared on page 7 of his sid Certificate of Identity
and that an entry visa to enter Saigon was granted to him on the 18th day of January 1974 for a stay of thirty days by the
former Vietnamese Consulate-General in Hong Kong is also endorsed
on page 9 of his said certificate of Identity.
