Further to Mr. Rowlands' letter of the 30th August, Mr. TAN and his wife have now been interviewed in Ho Chi Minh City by Mr. Maideen. Mr. TAN told him that he had made only one visit to Hong Kong, in October 1974, which had lasted for about a month. wife, however, visited Hong Kong on average about once a year between 1961 and 1974 and usually stayed about 2 weeks. Her longest stay was for seven weeks in 1969.
I have now been able to establish to my satisfaction that neither of Mrs TAN's parents has ever been a resident of Hong Kong. Mr. Maideen has been unable to elicit any compassionate or humanitarian factors which might justify the exceptional admission of the whole family to Hong Kong and I therefore see no reasons for reversing our decision. However, Mr. TAN has sent a letter to the Governor similar to that addressed to HM the Queen and after taking legal advice we have decided that this letter must be regarded as a statutory objection under Section 53 of the Immigration Ordinance and put to the Governor-in-Council for a decision. This will take about six weeks.
I will let you know the outcome of the petition in due course. In the meantime, I assume that you will send an interim reply to Miss DAM Le Quan.
