As Mr David said in his letter of the 4th October in reply to your letter to Her Majesty The Queen, nothing could have appropriately been done until the decision of the Governor of Hong Kong and his Counsel. I regret that I have now learnt that your application has been turned down. I am afraid there is nothing more we can do. This decision does not, of course, affect in any way your own right of entry to Hong Kong.

OBJECTION BY MISS DAM LE QUAN AGAİNST THE REFUSAL OF HER FAMILY'S APPLICATION TO

ENTER HONG KONG FROM VIETNAM

Annexed for the consideration of Honourable Members is an objection by Miss DAM Le-quan under section 53 of the Immigration Ordinance (Chapter 115) against the Director of Immigration's decision to refuse the application of her father, Mr TAN Tse-chuan, her mother, two brothers and sister to take up residence in Hong Kong. The

petitioner is an 8 year-old girl who acquired citizenship of the UK and Colonies by birth in Hong Kong during a visit by her mother who holds a Taiwanese passport.

The Director of Immigration's comments

Mr TAN Tse-chuan is aged 50, was born in China and has lived in Vietnam for the past 22 years. In January 1977 Mr Tan applied for visas for himself, his wife and four children to join his sister for settlement in Hong Kong. The sister is married to a Hong Kong resident and has lived here for 17 years. She has a family of two children. The application was refused on 7th July 1977 because it was outside normal immigration policies and because there were insufficient strong grounds for treating it as an exceptional case. is against this decision that the objection is lodged.

At the time of Mr Tan's application in January 1977 it was noted that one of his children was born in Hong Kong and thus has a right of entry. The birth of a child in Hong Kong does not, however, give its parents or other family members any right to reside here.

The Director of Immigration has reviewed Mr Tan's case in the light of the additional information given in the petition, parti- cularly the inheritance of property from Mr Tan's mother. Entry for the purposes of inheritance is not specifically covered in immi- gration policies and applications for entry for this purpose are rare. It is however unlikely that an application by Mr Tan in 1969 (when the inheritance occurred) would have been successful on the information now available and the Director of Immigration considers that there are even less grounds for approving such an application now, 8 years later. The family hold Taiwanese passports and although Mr Tan has visited Hong Kong only once, his wife paid regular yearly visits to Hong Kong
