points of doubt, the Immigrant should be allowed to tell his story in his own way without prompting. Care must be taken not to ask leading questions.

10(TCC) will complete (in duplicate) the rest of the questionnaire in Parts A and all Part 0 of the Immigration Interview Report. Having done so he will assess whether or not the immigrent has any grounds for being permitted to land in Hong Kong, and will make his recommendation in Part D of the Report.

To assist the appropriate officer in deciding whether or not an illegal immigrant should be returned to Chine, it is necessary to establish :-

(a)

whether there are reasonable grounds for believing that the immigrant

(i)

was born in Hong Kong or has "Chinese Resident" status. The onus of proof will rest with the immigrant, but there can be no question of his being released or given facilities to seek evidence. If, as a result of his statement there seems to be a real possibility that a claim to such birth or status is valid, enquiries are to be instituted through P10(1) to determine its validity as soon as possible;

(ii) is a political refugee (such cases should be

referred to S.B.);

(b) whether there are strong humenitarian reasons e.g.

physical disability which makes his return undesirable. 10(TCC) should note on the form whether there are any outward signs of physical injury, disability or disease.

It should be noted that the presence of close relatives in Hong Kong does not constitute a good ground for giving permission to lend. However, spouses, or young children arriving together will not be seperated. Usually, the decision on an adult will also apply to his/her dependants.

In reaching his conclusion, 10(TCC) must watch for false claims to Hong Kong birth or to "Chinese Resident" status. It must also be remembered that the interval between apprehension and return must be kept as short as possible, so that screening must be conducted very quickly.

llaving completed and signed his assessment 10(TCC) will pass the form, 1.D.

and documents etc to the interviewing officer of the Immigration Clearance Office who will, after completing his scrutiny -

(a) retain the duplicate 1.0.

(b) pass the immigrant, together with

(i) the original copy of form 1.D.

any travel document or identifying paper which the immigrant may have with him

to $10(TCC) for final assessment..
