Deportation Tribunal under s.22(1) of the Immigration Ordinance (Cap.115) Re Thin Moon Fatt, @ Tin Woon Fat,

@Tin Wun Fat, aged 22, Respondent

We sat today as a Tribunal to consider the case of this

Chinese man in respect of whom the Attorney General has proposed that a deportation order should be made under s.22(1)(b) of the Immigration Ordinance on the ground that being a Chinese resident as defined in the ordinance he has been found guilty in Hong Kong

of an offence punishable with imprisonment for not less than 2 years. Mr. McPhail, Crown Counsel, appeared for the Attorney General. The Respondent who had been duly served with notice of the Tribunal, appeared in person and was given the opportunity to make any representations that he wished.

There is no dispute as to the facts and we accordingly

find as follows. The Respondent is 22 years of age. He was born in Penang on the 15th April, 1955 and entered Hong Kong in 1965 from Malaysia and has lived here since. His first criminal convictions were on 4th March, 1975 when he was sentenced to 18 months imprisonment concurrent on each of 31 counts of blackmail. He was, on the 17th September, 1976, fined $750 on conviction of the charge of suspected person found loitering and finally on the 29th March, 1977, he was convicted of theft in the Magistrate's Court at South Kowloon and sentenced to 4 months imprisonment. He has admitted to being an associate of persons claiming to be members of a triad society and involved in their activities.
