On the other hand, the Director of Immigration in Hong Kong in a letter he wrote to the Home Office on 24 December mentioned in passing that 1.6 million Chinese in Hong Kong not regarded as CUKC's are regarded as "stateless". This sounds as though he is taking the view, which I have heard before, that Peking has washed its hands of those Chinese who have gone off to Hong Kong and no longer sees them as being Chinese nationals.

In view of this apparent conflict of view as to the Chinese attitude towards the Chinese in Hong Kong I think that the safest course is to avoid any statement in the Appendix to the Green Paper which amounts to a prediction of the Chinese Government's attitude. This was the view expressed in Mr Orr's minute of 29 December and Mr Stewart minuted at the time that he agreed with it. In short, while being less than sure about the right course, to adopt, I would still prefer to omit from the annex to the Green Paper any statement qualifying the figure for the number of CUKC's in Hong Kong.

I imagine that further work on the proposed Green Paper may have been put in suspense following the views that the Prime Minister has expressed (Mr Brown's minute of 4 January attaching a copy of No.10s letter of 31 December to the Home Office). Incidentally, we in HKD would be interested to know whether the Secretary of State has sent a minute to the Prime Minister and his colleagues along the lines of that attached to Mr Brown's submission of 9 December.
