(a) the Town Planning Board had no power under the Town Planning Ordinance or otherwise to impose limitations on plot ratio; the Board could only zone areas or districts as to use and not intensity;
(b) the plot ratio restriction was contrary to and a
derogation of the lease conditions and explicit
terms of Agreement and Conditions of Sale under which land is held;
(c) it was contrary to public policy with regard to
unrestricted leases which should not be restricted by statutory measures except in the most exceptional circumstances;
(d) it was contrary to the Density Zone III controls set
out in the Density Zoning Plans and Schedules of 1st April 1966;
(e) it would discourage the redevelopment of old and dilapidated buildings, and buildings at the end of their economic life all to the detriment of the environment and it would result in the inefficient use of land:

(f) it would prevent redevelopment of buildings, destroyed by fire or other catastrophe, to their previous density;
(g) it would adversely affect site values and cause huge
financial loss to owners without sufficient or adequate reason, and this would destroy confidence in land values generally;
(h) it would be detrimental to a considerable section of
the public who are share-holders in Public Companies;
(i)
it was iniquitous without amending legislation to provide fair compensation to the affected owners;
(j) it would be a fatal blow to the attempts of bona fide
developers and private owners to alleviate the housing shortage;
(k) it would aggravate the acute shortage of building land
for residential purposes;
(1)
it would create a privileged area likely to incur resentment among the vast majority of the Chinese population.
