REVIEW OF THE APPLICATION OF ILO CONVENTIONS

As you know, it has been agreed that the Hong Kong Government should aim to make improved declarations on six ILO Conventions during the current year. So far two declarations have been made on Convention 92 (Accommodation of Crews (Revised) in January and on Convention 94 (Labour Clauses (Public Contracts) in May. In his letter of 4 May to Lord Goronwy-Roberts the Governor gave details of the legislation which is needed before declarations on the remaining four Conventions can be made and he indicated the approximate time- table under which it is hoped the legislation will be enacted.
2. The Governor will no doubt be shortly sending a further progress report in response to the request in the final paragraph of Lord Goronwy-Roberts' letter of 7 April but we thought it might be useful if we summarised the position as we see it on the basis of information already available to us here. This is as follows:
Convention 17 Workmen's Compensation (Accidents)
Drafting of the Workmen's Compensation (Amendment) (No 2) Bill is under way and should be completed in the quarter ending 30 October, making it possible for the Bill to be enacted during November.
Convention 42 Workmen's Compensation (Occupational Diseases)
In his letter of 4 May the Governor expressed hope that legislation would go through this year but at that stage he could not be absolutely sure.
Following the discussion of new proposals with the Accident Insurers Association a first draft of the legislation needed to amend the Workmen's Compensation Ordinance and to set up an insurance pool is now being prepared; this should be completed in time for a bill to be introduced in Legco during the last quarter of the year.
Convention 90 Night Work of Young Persons (Industry)
Drafting of the Factories and Industrial Undertakings (Amendment) Bill should be completed by the end of October and the Bill enacted before the end of the year.
