ARTICLE 12 (PREVIOUSLY ARTICLE 14). THE COMMISSION NOW ACCEPT THAT THE REVIEW CLAUSE SHOULD BE INCLUDED AS IT STANDS OR OMITTED

COMPLETELY.

ARTICLE 15 (PREVIOUSLY ARTICLE 17). THE COMMISSION HAVE NOW INCLUDED PROVISION FOR REFERENCE TO THE TSB BY EITHER PARTY IF THE CONSULTATION PROCEDURE DOES NOT LEAD TO AGREEMENT. THIS WAS OPPOSED BY ALL MEMBER STATES INCLUDING THE GERMANS WHO ARGUED THAT THIS WOULD GIVE THE TSB A ROLE AS ARBITRATOR WHICH WAS NOT WARRANTED UNDER THE MFA.

ARTICLE 18 (TRANSITIONAL ARRANGEMENTS). WE INSISTED THAT SHIPMENTS IN THE TRANSITIONAL PERIOD SHOULD BE LIMITED TO 30 PERCENT OF THE ANNUAL QUOTA. SO FAR THIS HAS FOUND LITTLE FAVOUR AMONG OTHER MEMBER

STATES.

PROTOCOL A ARTICLE 7 (PREVIOUSLY ARTICLE 8). 'REFUSE' HAS BEEN REPLACED BY 'SUSPEND'. THERE WAS GENERAL AGREEMENT THAT THIS WOULD HAVE THE SAME PRACTICAL EFFECT.
