Restraint level by reference to previous situations.

In order to achieve in practice a better balance between the different supplier countries, in particular; by means of bilateral negotiations, the present provisions of Annex B.1(b) should not

be invoked against the Community, especially by the large exporting countries.

Interpretation of Annex A

In the light of its experience, the Community considers that the following elements should be taken into account amongst those which contribute to causing a situation of market disruption:

the rate of penetration of the market of an importing country;

the evolution of domestic consumption;

- the cumulative effect of imports;

the "price" factor taken in isolation.

Handloom or handmade products

Article 12 (3) of the MFA is open to misinterpretation. possible ambiguity should therefore be removed. For these products to be excluded from the MFA they should be "properly certified under arrangements established between the importing and exporting participating countries concerned". In other words, in the absence of specific arrangement between the countries concerned, or in the case of the unsatisfactory operation of such an arrangement, these products are automatically covered by the MFA.

It should also be specified that:

cottage industry fabrics must be woven on hand or foot operated looms;

hand-made cottage-industry products made of these fabrics must be hand sewn without the aid of any machine;
