9. The Land Policy of Government is undoubtely unfair and unreasonable but unfortunately as the law now stands, the Court cannot interfere with the policy makers' decision as the policy makers are able to hide behind the clock of legality given to them by the Crown Lands Resumption Or- dinance and the Lands
the Lands Tribunal Ordinance. Where Government may appear to be generous by way of the Letter B offer, on analysis is in fact window-dressing and a cheap and profitable means by Government to obtain private land.
10. Most land which has been resumed have be- longed to villagers who have owned the land since time in memorial and forms part of the tradition and custom of the New Territories. In the name of modern progress, these lands have had to be given away by these poor villagers to enable Hong Kong to expand and progress, but these villagers by reason of the Government un- fair land policy do not derive any benefit or see any of the prosperity given to Hong Kong by such loss of land. Should these villagers whose livelihood, culture, and tradition permanently lost not also be entitled to share in the prosperity of Hong Kong which has been contributed by contributed by their sacrifice? Should Govern- ment continue to make such profits at the expenses of the poor people? When will Govern- ment fulfill its promise to these poor people bearing in mind Government's dubious records of broken promise?
11. The Heung Yee Kuk is making this statement to let the public judge for themselves as to whether the Government's Land Policy has been fair.

To provide for the establishment and functions of an advisory and consultative body for the New Territories and for purposes connected therewith.

Preamble.
WHEREAS—
(a) the HEUNG YEE KUK has in the past served as a valuable advisory body to the Government on New Territories affairs and has been a forum where leaders of opinion in the Territories have been able to exchange views; and
(b) it is now considered desirable that the HEUNG YEE KUK should become a statutory advisory body with a constitution so framed as to ensure that it will as far as possible be truly represen- tative of informed and responsible opinion in the New Territores:
PART I.
Establishment and Constitution of Heung Yee Kuk. Short title.
1. This Ordinance may be cited as the Heung Yee Kuk Ordinance.
Establishment and constitution of Heung Yee Kuk.
2. (1) There shall be established in the New Terri- tories, which expression shall be read and construed in this Ordinance as meaning the New Territories exclud- ing New Kowloon, a body to be known as the Heung Yee Kuk (), hereinafter referred to as the Kuk.
