sanitation purposes; (2) other health reasons; (3) naval and

military purposes; and

resumption for any purpose of whatsoever description, whether ejusdem generis with either of the above purposes or not, which the Governor- in-Council may decide to be a public purpose".

Territories.

This Ordinance was expressly applied to the New

"Land" in Section 2 of the Ordinance included

all land within the limits of the Colony "as enlarged by the

Convention dated 9th June 1898

The meaning of "resumption for a public purpose"

under the Crown Lands Resumption Ordinance, 1900, was further

extended by Section 4 (2) of the Town Planning Ordinance, 1939,

as to include the resumption of any land to avoid interfering

with the Town Planning Board's plans for the lay-out of any

Since the enactment of these Ordinances, the Crown

has frequently exercised its powers of resumption in the New

Territories for a variety of public purposes such as the construc-

tion of reservoirs, catchments, tunnels, roads, flyovers and

buildings of various kinds. In all such cases, compensation has

been awarded, at first by the Board of Arbitration, then, the

Land Resumption Board and, under the existing law, by the Lands

Tribunal.
