being accused all along by this lady over the whole week

of stealing the money building up a hatred and revenge,

so much so that he planned that morning to go down and

finish her off? Or is it that he was annoyed but kept

himself under control, and it was only when he went to

the room that morning, to get a stout and she again put

the thing to him, that he got off suddenly?

It is only

his evidence to say what happened down in the grocery

and in the pool room. There is no one else who can tell

you what happened down there, because no one else was

present. So he tells you that she told him these things.

Well as I said, such has been the nature of his evidence

you might find that he has been all along basically a

truthful witness. Even in this trying of moment he has

been a truthful witness, you might think. But the Crown

will want you to say that it is only a made up story, that

he planned this thing all along, all through the week,

that he was building it up and so he planned it and

that's why he got the knife before, and why he had the

cord, and why he packed his clothes, and that's how he

had everything in preparation. That's why he told his

sister he is going to leave because of immigration, he

planned it. But he says no. I heard her accuse me

several times and I was annoyed, I didn't lose my control,

but it happened when I got down there when she told me this

thing again, that was the last straw, and it just burst

and I lost my control. That's his story.

So you have to decide because in every case the

Crown has to prove its case to your satisfaction and he

hasn't got to prove that he was provoked, he has raised it

as a defence and there is sufficient evidence for you

to consider it. But I have told you all this because if
