on the 19th January,

1977. I had stayed at the airport

from minutes to 10.00 a.m. until minutes to 12.00 midday

when I went up where I had worked. When I ran through

the busines I climbed a tree. The Immigration fellow

saw me up in the tree, he called me down and

I came down. They took me to the jeep and took me

to Police Headquarters. They gave me three fists in

my face on my way to Police Headquarters.

At about 10.40 a.m. on the 20th January, 1977 the

police officer who took down my statement showed me a

folded steel knife, and that was the knife I used to

stab Miss Evelyn. The same policeman also showed me

a string and that was the same string I used to tie

Miss Evelyn's neck. I now know the policeman's name

to be Sgt. Malone".

That's the story that he told the police, its part

of the Crown's case and it is part of the Defence because

the accused relies on it. He gave evidence from the

box there, and that evidence as I said awhile ago coincides

very materially with that statement. In this evidence he

gives some further information which is useful for you to

think about and consider. I am going to read that for

you.

"On the 19th January I was living at Major Bay. I

came to Tortola sometime last year. I could stay

permanently. I live at Major Bay with my sister, Julita

Gaston and her boyfriend, Vancito Pickering. I know

Evelyn Rabsatt. She lives a few yards from where I

live. I went to school on the island of St. Lucia. I

did remember going to primary school and because of age I

was moved up to another class. I passed my school exams.
