RACIAL COMPOSITION OF JURY

The Bermuda Juries Act 1971 provides for a revising tribunal to certify that persons qualifying for jury service are fit to serve. That tribunal also, at the same time, notes

which of the persons certified fit for service would be qualified to serve on a special jury. The qualification necessary is the ability to follow a complicated case.

In the Court of Appeal Tacklyn's QC specifically disclaimed any intention of attacking the jury's racial balance (9 white, 3 black).

ON WHAT AUTHORITY IS A PARTICULAR CASE TRIED BY SPECIAL JURY?

Only a judge may order that a particular case shall be tried by special jury.

WAS THE VERDICT UNANIMOUS?

No, it was a majority verdict but the size of the majority is not known.

POWERS OF THE SECRETARY OF STATE TO INTERVENE

The Secretary of State could only intervene in the event of a serious miscarriage of justice.
