39. (1) Every registrable workplace shall be provided with sufficient and suitable latrine and washing conveniences on the premises and, where persons of both sexes are or are intended to be employed such conveniences shall afford proper separate accom- modation for persons of each sex.

(2) Any latrine or washing convenience which does not comply with the provisions of the Buildings Ordinance shall be deemed not to be sufficient and suitable for the purpose of this regulation.

40. In every registrable workplace an adequate supply of drinking water either from a public main or from a source approved in writing by a health officer shall be provided and maintained at suitable points conveniently accessible to all persons employed.

PART V

BUILDING AND ENGINEERING CONSTRUCTION SITES

42. For the purposes of regulations 23, 24, 25, 30, 31, 39 and 40, the term "registrable workplace" shall be deemed to include any building or engineering construction site notwithstanding that such site is not required to be registered under section 9(1) of the Ordinance.

42A. In any building or engineering construction site which is not required to be registered under section 9(1) of the Ordinance there shall be provided and maintained an adequate supply of first aid equipment on a scale commensurate with the number of workers employed in the building or engineering construction site together with simple instructions for the use of such equipment.

PART VI

OFFENCES AND PENALTIES

43. Any person who contravenes any of the provisions of regulation 4, 5 or 6 shall be guilty of an offence and shall be liable to a fine of five thousand dollars.

44. Any person who-

(a) contravenes any of the provisions of regulation 16F(2),

20(4), 21 or 31(2); or

(b) contravenes any of the provisions of any order made

under regulation 30(1),

shall be guilty of an offence and shall be liable to a fine of one thousand dollars.
