and carry out all reasonably necessary
work of a preventive or remedial nature.";

(b) in subsection (4) by inserting after "to
repair" the following
"or detect".
Explanatory Memorandum
The purpose of this Bill is to amend and
clarify section 12 of the Ordinance.
The existing provision confers a right of
entry and a right to do preventive and remedial work
with respect to buildings situate within 30 metres
of the railway area and it is proposed to amend this
figure to 70 metres. The new section 12(1) rephrases
the section to make it clear that the Director of
Public Works or any person authorized by him may,
subject to the procedure in the section, enter property
when it is reasonably necessary to do so for the
purposes of the railway.
A minor amendment to section 12(4) ensures
that entry may be made and work done for the purpose
of detecting possible damage caused by the construction
of the railway.
