Certain statutory provisions are not to apply

to the Corporation (clause 21) viz., the Railways

Ordinance (Cap. 99); the provisions of the Public

Health and Urban Services Ordinance (Cap. 132) as

detailed in the Schedule; the Buildings Ordinance

(Cap. 123) as regards building works required for the

railway; and the provisions relating to noise at night

in section 13 of the Summary Offence Ordinance

(Cap. 228).

Regulations and By-laws

The Governor in Council may make regulations

for the control, regulation and safe operation of the

railway (clause 24). The Corporation may make by-laws

concerning the use of the railway by the public and

their conduct, advertising on railway premises, lost

property, and the protection of the property of the

Corporation (clause 25(1)). Such by-laws must be

approved by the Legislative Council (clause 25(2)).

Regulations and by-laws may create offences

and authorize railway employees to detain offenders

(clause 26).

Regulations and by-laws may provide for the

application of the provisions of the Public Health and

Urban Services Ordinance (Cap. 132) as to the seizure

and forfeiture of hawkers' goods and equipment where

a "hawker offence" has been committed (clause 27).
