On 19 November, 1974, I together with three others namely; MA Sung-lee, NG Lee-kin @ FONG Lee-kin, FONG Chong-ming @ FONG Tung @ FONG Muk-tung was convicted in the Supreme Court of Hong Kong, upon a verdict of a Jury of six persons, of the offence of murdering LAM Po alias LAM Sum-shui, and was for that offence sentenced to suffer death in the matter authorized by law.

That on 8 April, 1974, the appeal of your humble petitioner was dismissed and he is now a condemned prisoner awaiting to be executed for the offence of murder.

That your humble petitioner is seeking mercy from Your Excellency the Governor to save him from this punishment.

That your humble petitioner was born on 10 December 1950 and is single and is now aged 25. He has lived in this Colony since 1951 having been brought to the Colony as an illegal immigrant by his parents from Chiu Chow, Kwongtung Province, Mainland China. His education was terminated at the age of fifteen having reached primary five level as a result of which he is not too educated; this was because his father suffered an illness and was hospitalized had an operation and so could not support the family, which is comprised of the father, the mother, your humble petitioner and his younger brother. After leaving school at the age of fifteen your humble petitioner worked to help in sustaining the family.

That your humble petitioner strove to earn an honest living, and since 1966 has worked as a delivery boy in a plastic factory, a worker and then a skilled worker in a weaving factory and helping his father sell fish both part time and full time up to the date of his arrest. On each occasion changing his employment in order to better himself and to improve his standard of living

and to assist his family in a greater way.

That although your humble petitioner has two previous convictions one being at the age of eleven for larceny for which he was cautioned, and one at the age of eighteen for conspiring to commit a robbery and possession of an instrument fit for unlawful purposes for which he was placed on probation for eighteen months this is the first occasion on which he has been charged or convicted of any offence involving violence.

That due to the impoverished circumstances and lack of education of your humble petitioner, found himself associating with and being influenced by persons of a criminal disposition and those who made a living by dishonest and unlawful means.

That inspite of becoming thus associated, your humble petitioner strove to earn an honest living and succeeded at doing this, by his efforts at the jobs set out in paragraph five herein.
