REFERENCE CIRCULAR DESPATCH NO 25/69 OF 21 FEBRUARY 1969 FROM THE RT HON MICHAEL STEWART

APPLICATIONS BY PERSONS UNDER SENTENCE OF DEATH FOR SPECIAL LEAVE TO APPEAL TO JUDICIAL COMMITTEE OF THE PRIVY COUNCIL.

Enclosed with the Despatch under reference were revised "model" Rules in respect of applications from those persons referred to above. The Despatch requested you to consider substituting new rules for those introduced following Mr Oliver Stanley's Despatch of 18 July 1944 ("The Indian Rules"), in the territory under your administration. Further guidance was contained in Despatches 32/70 of 7 May, 1970 from Mr Michael Stewart and 68/70 of 1 December 1970 from Sir Alec Douglas-Home.

2, The need has now arisen for up-to-date information regarding the Rules currently in force in your territory; it would be appreciated if you would send me one copy of these Rules, and advise me if, in future, you intend to make any amendments to them.

3. As you know, it is the purpose of these Rules to ensure that applications from persons under sentence of death are processed in an expeditious manner; hence, where this Office is to be notified under the rules of any matter, notification should be by telegram.

4. Legal Executive Branch will be the department responsible for action to be taken under the Rules by this Office.

5. For your convenience I am sending separately a copy of the despatch under reference, a copy of the revised "model" Rules, and a copy of each of the further despatches referred to in paragraph 1 above, together with copies of the following despatches from my predecessors: 258/67 of 28 September 1967, 103/68 of 20 August 1968, and 2/71 of 14 January, 1971, all of which deal with the payment of appellants' costs in criminal appeals in forma pauperis.
