P.C.2752 told the Court that when he descended from the

police vehicle he chased the person nearest to him. He identified

that person as No.1 above. He was unaware that the Sergeant and

P.C.9611 were also chasing him. He said before he reached the Light

Bus, and when No.1 had reached No.185 he saw him draw a gun and aim

at him as though to shoot. He said he took cover and heard two or

three shots. P.C.2752 drew his revolver and later walked quickly,

but not running, towards Tai Po Road. There he saw a yellow car moving

off, and the man beside the driver was No.1. The P.C. said he fired

one shot from inside a preserved meat shop and one or two shots were fired

in return breaking the shop window. He returned along Pei Ho Street

and on the way back found a plastic bag, later ascertained to contain

$118,085.

The owner of the yellow car gave evidence. He said he and

his brother were stopped at the traffic lights near the preserved meat

shop when they were ordered out of the car at gun point by a man who

got into it followed shortly after by another.

It might be of some interest to visualise the position of

all concerned at the time of the shooting as told by the two police

witness.

If one imagines a right-angle triangle one side being the

footpath, the base being from the point on the path where P.C.2752

says he was to a chemist's shop on the opposite footpath, and the

hypotenuse extending from that shop to where P.C.9611 said the 1st accused

was at No.185. From where the 1st accused is alleged to have been to the Light Bus and P.C.9611 is about 4 way along the hypotenuse.

people including the little girl, were wounded at the chemist's shop

by bullets. (The accused were charged with wounding them but I did

not allow the prosecution to proceed with the three counts and they

still stand on the indictment).
