On rereading our letter of the 30th May, I notice that it was not stated that it was not our intention that a copy of the Oper- ations Target Committee report should go to or be seen by Mr. Ellis himself although obviously a copy could be made available to Sir Anthony Royle. As a matter of policy these committee papers are very rarely circulated outside the Commission. In certain circum- stances copies are sent to Heads of Departments but this is very much the exception. Where private individuals or firms are concerned, especially if they are the complainants, it is the policy to give them a very brief summary of the investigation, with details of the outcome and of the recommendation of the Operations Target Committee. In delicate or sensitive cases we would pass on only the outcome and the Committee's recommendations.
I would strongly recommend that too much detailed information is not given to Mr. Ellis for he will almost certainly misuse it. Statements from witnesses are taken with some promise of confidentiality in all circumstances short of court or disciplinary action. I would for instance be most reluctant to let Mr. Ellis know the names of the people interviewed. I have therefore prepared a rough draft of what we would say to Mr. Ellis were we writing to him direct: this may be of some help to Sir Anthony.
A check of documents on the files dealing with this case held in the Colonial Secretariat has shown that there was a record there of Mr. Ellis's interview with Mr. Anthony Royle (as he then was) on 5th April 1973, and of a letter from Mr. Ellis dated 1st April 1973 accepting the invitation to meet Mr. Royle. In the letter Mr. Ellis refers to the offer of $500 on two occasions by a station runner "in the name of my senior divisional officer" ; while during the interview he mentioned the same incident in passing. These papers were not amongst those taken over by ICAC from the old ACO nor were they available to my investigating officer: they do not, however, provide any detail of the events nor could my investigator find the record of any such detail on other files
