a) it is likely that the life of the prisoner will be endangered or his health permanently injured by further imprisonment in the Colony; or b) that it is expedient for the prisoner's safer

custody or for more efficient carrying out of his

sentence that he should be removed as there is no prison in the Colony in which the prisoner can

properly undergo his sentence.

It would be difficult to argue that there is a legal case for Godber's removal under this Act; and to bring Godber back to the United Kingdom would cause deep public resentment, particularly after the efforts that had to be made to return him to Hong Kong to face trial.

5. I accordingly recommend that Lord Goronwy-Roberts should reply to Mr Godman Irvine on the lines of the attached draft letter. The Department's Legal Adviser concurs.
