There is, of course, only one allegation of corruption in Mr. Ellis' statement and this refers to two attempts by a room boy in 1962, to give him $500 allegedly on behalf of the Divisional Superintendent. As the law stood at that time, there being no provi- sion comparable to Section 3 of the present Ordinance, no offence of corruption was committed even if the allegation is true. The only possible offence would be a common law conspiracy but to prove this we would, of course, have to establish what the conspiracy was about something which would be virtually impossible at this point in time.
It is unfortunate that Mr. Ellis made no re- ference to the incident he described in his statement until some 21 years after he had left the Royal Hong Kong Police and it is not until now, some 12 years later, that he has come forward with details of the incident. Nevertheless, it is intended to try and locate the room boy concerned though, as the only information is that his name is $
this could
prove most difficult. Even should he be located, there remains the probability that he would not be prepared to confirm Mr. Ellis' story.
As you will appreciate, the more time that has to be spent in going over old chestnuts such as this, the less time can be devoted to tackling current cases of corruption.
