REASON WHY GODBER COULD NOT BE EXTRADITED EARLIER
1.
Proceedings for Mr Godber's extradition were commenced immediately evidence supporting a charge for a returnable offence was available. Investigations into a possible offence by Mr Godber under Section 10 of the Hong Kong Prevention of Bribery Ordinance were at an advanced stage when he fled from Hong Kong in June 1973. Since there is no corresponding offence under United Kingdom law, he could not, under the provisions of the Fugitive Offenders Act, be returned to Hong Kong for trial
for an offence under Section 10 and a returnable offence had to
be established.

ACTION TO COMBAT THE GENERAL PROBLEM OF CORRUPTION IN HONG KONG
2. In 1973 the Governor appointed a judge of the High Court, Sir Alastair Blair-Kerr, to investigate the departure of Mr Godber from Hong Kong and to propose further measures. Sir Alastair's recommendation the Governor has since appointed an Independent Commission Against Corruption. This began operations in February 1974. Its functions are to investigate complaints of corruption, to take steps for the prevention of corruption and to enlist community support for its elimination.
