1. I agree that we should now seek the views of Legal Advisers about the points of difference between the law and the requirements of the Convention and that these points are those set out in Mr Hurst's minute of 18 April at (3).

2. The difference between ourselves and the Hong Kong Government is slight i.e. that there should be 2 modifications in respect of Article 2 and not 1 as suggested in paragraph 3 of Hong Kong Savingram at (1).

This case is not as critical as Convention No.98 since in that case we are aiming to make a declaration of full application. In this case, with the agreement of the Hong Kong Government, we are making a declaration with modifications i.e. in respect of Articles 2 and 5 of the Convention.

4. If Legal Advisers concur with our interpretion of the law, it will only remain to clear with Hong Kong that interpretation, and obtain their agreement that a second modification is required in respect of Article 2 (as described in Mr Hurst's minute under reference).
