1. The Commissioner of Labour, Hong Kong, will attend the Conference as an Adviser to the UK Government Delegation and will be briefed in regard to this matter. The terms of his brief have still to be agreed with the Government
of Hong Kong.
2. As background information, however, it should be noted that a wide revision of the Factories and industrial
Undertakings Ordinance is at present under consideration and it is expected that the present difficulties in regard to Convention lio. 5 will be resolved when the revision is completed. This is not expected to be before 1976. The difficulties in application, as seen by the Government of Hong Kong, were set out in detail in the briefs prepared for the 56th at 58th Sessions of the IL Conference, In views of the long standing nature of the Committee of Experts Observations, copies of these earlier briefs are
attached for ease of reference.
3. If the matter is raised in the Conference Committee on the Application of Conventions the British Government Representative should reply on the following lines:
"a comprehensive review is being made of the Factories and Industrial Undertakings Ordinance and subsidiary legislation made thercunder. The Labour Adviser who has been recruited from Hi Inspectorate of Factories on secondment since September 1973 is expected to produce a report prior to the end of his secondment in March 1976, recommending, inter alia, suitable action to be taken to amend the legislation referred to above.
