6. Although Mr S R Withers has not himself been charged or convicted of any offence in Hong Kong, the Hong Kong Government are fully entitled to take the view that his entry into Hong Kong would be against the public interest.

I therefore recommend that we should simply tell Mr Withers that we have noted his comments and that we are bringing them to the attention of the Hong Kong authorities. The Department's Legal Adviser agrees. I would not normally bring the case to your attention, but that Mr Withers is clearly a persistent person who may well try to approach Ministers.

8. I submit a draft letter from me for your approval.
