REMOVAL FROM HONG KONG OF MR D J JENKINS

Sir Anthony Royle MP has written to the Secretary of State enclosing correspondence which he has received from his constituent Mr D J Jenkins. Sir Anthony's letter was first referred to Migration and Visa Department for draft reply from Mr Ennals. But it has been transferred to HKIOD, and Mr Ennals's and Lord Goronwy-Roberts's Private Offices have both agreed that it

would therefore be more appropriate to submit a draft reply from Lord Goronwy-Roberts.

Mr Jenkins, a British citizen, is complaining against the Hong Kong Chief Immigration Officer's refusal to allow him to enter the Colony when he arrived at Kai Tak airport, on a flight from London, on 7 November. He was carrying £206; but he did not have a return ticket, and he was refused permission to

communicate with his London bank in order to obtain their

confirmation that he had sufficient funds to finance, if necessary,

his return passage.

Hong Kong's Immigration Ordinance gives the Director of Immigration wide powers to refuse entry to any person who, for example, "is unable to show that he has definite employment awaiting him or that he has a reasonable prospect of obtaining such employment or that he is a person of independent means". it does seem, especially in view of the summary "Entry Regulations" contained in the Hong Kong Facts and Information Manual, that Mr Jenkins may have some grounds for feeling aggrieved. He asks for a letter of apology from the Hong Kong Government, restitution of his outgoing fare, and repayment of his incidental expenses.
