Realization of international navigation is indissolubly connected with
calls and stay of vessels in foreign ports. Conditions of such a stay tell
quite considerably on general development of international navigation.
2. By virtue of one of the basic principles of international law the
principle of respect for the sovereignty of a State - a vessel in a foreign
port shall comply with the laws and regulations of the Coastal State,
particularly with respect to its border and custom regulations.
3. In accordance with present practice a Coastal State will not intervene in
the business of a foreign vessel and its jurisdiction with regard to it, unless actions by the vessel or persons on board are contrary to the interests
of this State or unless the master or the consul of the State whose flag the
vessel flies request such intervention.
4. With regard to foreign vessels in territorial seas this provision is laid
down in the Geneva Convention on the Territorial Sea and Contiguous Zone of 29 February, 1958 (Articles 19 and 20); with regard to foreign vessels in
internal sea waters including those of ports, customary law and local
jurisdiction as well as provisions of bilateral agreements are in force at
present. However, the absence of clear norms laid down in a multilateral
convention and regulating the regine of stay of vessels in foreign ports often leads to unnecessary complications in the relations between the master of a
vessel and local authorities.
