Part V Assessment and award of Compensation

The

Clause 25: The Lands Tribunal is to

determine all disputed claims for compensation.

Tribunal may also award the compensation to a

claimant where there is no dispute as to title but this

does not prevent the claimant's title from being later

attacked as being defective.

Clause 26: A mortgagee is to have his debt

repaid from the compensation in full or pro rata as

the case may require, the exact details of disbursement

to be agreed between the claimant and any mortgagee or

fixed by the Supreme Court.

Clause 27: The Tribunal may direct payment

of interest on compensation.

Clause 28: Compensation is to be paid out

of the general revenue of the Colony.

Part VI

Miscellaneous

Clause 30: The Director of Public Works

may delegate his powers, functions and duties to any

public officer in terms of this clause.

Clause 33: The disposal of any land or

easement acquired under this Ordinance is to be at the

unfettered discretion of the Crown.

Clause 34: A person, for example a trustee,

may apply to the Lands Tribunal for its certificate that

the amount of any settlement of compensation or sale

price is the best which could reasonably be obtained.
