Under item 7 of Part I of the Schedule any

person who has a compensatable interest in a building

which is damaged by the exercise of the powers in clause

12 may claim compensation for the cost of repairing the

damage and a disturbance payment for disturbance.

Clause 13: The Director may for the purposes

of the railway give notice requiring the owner or

supplier of any utility service to alter the course of

any apparatus and to repair a street surface thereby

disturbed. The contents of the notice is prescribed

in subclause (2).

Under item 8 of Part I of the Schedule

compensation may be recovered for the cost which is

fairly and reasonably incurred in giving effect to the

notice.

Clause 14: The Director may by notice to

the "owner" of any building in the railway area ("owner"

by definition means the lessee from the Crown of the

land on which the building stands) require him to remove

any object or structure which is attached to or projects

from the building. The contents of the notice are

prescribed by subclause (3). If the owner of the

building does not remove the object or structure any

public officer authorized by the Director of Public

Works may do so and an object or structure so removed

is forfeited to the Crown and may be disposed of as the

Director thinks fit.
