Clause 11: Notice of an order under clause

10 is to be given in a manner similar to the giving of

a notice of resumption. The contents of a notice under

this clause are prescribed by subclause (3).

Under item 4 of Part I of the Schedule any

person who would be entitled to claim compensation under

the Streets (Alteration) Ordinance (Cap. 130) if the

closure or substantial alteration of a street were

made thereunder may claim compensation for pecuniary

loss or damage as if the Streets (Alteration) Ordinance

applied. Under item 5 of Part I of the Schedule any

person who suffers a pecuniary loss by reason of the

extinguishment, modification or restriction of a

private right over Crown foreshore or seabed may claim

compensation for the pecuniary loss resulting therefrom.

Clause 12: The Director of Public Works may

carry out reasonably necessary preventive or remedial work

on any land or building in the railway area or within

30 metres thereof and may enter to inspect or survey

for those purposes.

Unless the Director considers

that an emergency exists or the entry is required only

for an inspection or survey the person entering must

give 14 days' notice to the owner and the occupier.

"Work of a preventive or remedial nature" is defined in

subclause (4) and the decision of the Director that

work comes within that definition and is reasonably

necessary is to be final.
