Resumption of

part of

land.

8.

(1) If it is established to the satisfaction

of the Governor that any land is, on the day on which

it is resumed under section 4(3), reasonably necessary

to the use and enjoyment of other contiguous or adjacent

land so that the other land cannot by itself be put to

any profitable use, the Governor may make an order under

section 4(1) in respect of that other land whether or not

it is within the railway area.

(2) Any person aggrieved by a decision of the

Governor under subsection (1) that at the date of

resumption any land is not reasonably necessary to the

use and enjoyment of other contiguous or adjacent land

may apply to the Lands Tribunal to review such decision.

(3) Upon an application under subsection (2) the/

Tribunal may direct that an order be made under section

4(1) by the Governor in respect of the other contiguous

or adjacent land whether or not it is within the rail way

area.

9. (1) Where in respect of any land notice has

been published in the Gazette in accordance with section

5(2)(a)(ii) or 7(2)(a)(ii) but the land has not yet

reverted to the Crown or vested in The Colonial Treasurer

Incorporated by virtue of section 4(3) or the easement
