To decide what reply should be given to a petition from
Mr Law Kam-sang to the Secretary of State, forwarded under cover
of a despatch from Hong Kong dated 10 April. Mr Law seeks the

reinstatement of the Crown land permits under which he operated
the quarry and which were cancelled in December 1970; or compensation in lieu.
BACKGROUND

The background to the case was set out in my submission
to Mr Youde dated 7 May. I then recommended, with the concurrence of the Department's Legal Adviser and of Gibraltar and General Department, that we should not accede to the petitioner's request.
Mr Youde did not dissent, but asked that further information should first be obtained from Hong Kong concerning: -
(a) the nature of the advance warning given to the
petitioner about the cancellation of the permit; (b) the date of the construction of the access road to
the petitioner's quarry; and whether, in view of its cost (HK$115,900), the petitioner might have an
equitable case for some form of compensation;
the nature of the circumstances under which

extensions were given to certain other permit-
holders.
We referred these points to Hong Kong, who have now
replied in a despatch dated 23 May.

ARGUMENT

I think that the information contained in Hong Kong's
latest despatch supports my earlier recommendation that the
