who is the subject of an investigation in respect of an alleged or

suspected offence under the principal Ordinance.

The new section 14A

provides that the Commissioner may serve a notice on a suspected

person specifying any property which that person may not dispose

of or otherwise deal with without the prior consent of the Commissioner

during the subsistence of the notice. The new section 14B deals

with the property of a suspected person in the hands of a third

party. This provision will enable the Commissioner to apply to

the District Court for an order restraining the third party from

dealing with such property of the suspected person as may be

specified in the order. The new sections 14C and 14D provide

for the revocation and variation of restraining orders and

enable the third party or the suspected person to apply to the

court for directions.

Clause 13 amends section 30 of the principal Ordinance

by adding a new subsection which gives the Commissioner a discretion

to disclose the identity of a person under investigation. In each

of the five situations where this discretion may be exercised the

fact that a particular person is under investigation will already

be known to that person and others.
