APPOINTMENT OF PUISNE JUDGES
1. I should be grateful for your advice on the procedure to be followed for submitting Mr Baber's name to Her Majesty (see folio 18 below).
2. According to Dependent Territories Departmental Practice, Part I Chapter 2 paragraph 15 (e), no formal submission is made to the Queen for the appointment of Judges other than Chief Justices.
3. As I was unable to find any precedent on our files I asked WIAD if they had recently been involved in the appointment of a puisne judge. They sent me papers concerning the appointment of a Mr Justice Staines in the British Honduras. In his minute of 4 December 1972 Mr Fifoot says "no formal submission is made" but a "recent submission from the Governor was a Curriculum Vitae" should be sought from the Governor.

As we have already received a recommendation and a Curriculum Vitae for Mr Baber from the Governor it is not necessary for us to go back to Hong Kong on this score. I would presume therefore that all that is now required is a telegram to Hong Kong saying that H.M. The Queen has been pleased to approve the appoint- ment. Is this correct?
