Re: Li Kit and other refugees entering

I have just received your letter which appears to have been posted by surface mail on 22nd October. I note what the Minister says concerning the power of detention under Section 32 (Section 18 is not directly relevant) of the Immigration Ordinance. The refugees were apprehended on 2nd June and as late as 14th June, the Director of Immigration was asserting that no decision had then been taken to deport them. It therefore follows that at least until 14th June, if not later, the Director had no power to detain the refugees under Section 32 since that section applies only where "a person

is to be removed from Hong Kong under Section 18". It therefore follows that until a decision was taken to deport the refugees, presumably over the weekend of 15th/16th July, the detention was unlawful.

I also note that Mr. Collard, the Director of Immigration, has denied uttering the words which I attributed to him in reliance on a newspaper report, a copy of which I sent to you. It is surprising that, so far as I am aware, Mr. Collard has not taken any proceedings against the newspaper concerned nor publicly issued a denial that he uttered the words nor has Government Information Services made such a denial; nor has the newspaper published an apology or correction so far as I am aware,
